Wedding Video Contract

These terms and conditions are the basis for which “Videographer” and the client(s) hereby accepts said terms and conditions of this agreement.
1. It is understood that we are to be the primary Videographer to cover this event. Any conflicts with other photographic and/or video coverage and any notifications necessary to avoid such conflicts are the sole responsibility of the client.
2. Client assumes all responsibility for obtaining any necessary permissions, clearances, permits, etc. which may be required by the Videographer to videotape the event, public or private. Client is solely responsible for any parking, admission fees, passes, tickets, etc., necessary for Videographer to gain access to and videotape the event. Client assumes all responsibility for obtaining and retaining permissions for access to any requested camera positions and is thereby responsible for the content of the final production based upon such requested camera positions.
3. Videographer reserves the right to remove equipment and personnel from an event for any reason when, in the discretion of the Videographer, there is sufficient potential to cause equipment damage or personal injury to the videography crew.
4. Client will provide Videographer staff food service during the guest meal service if video coverage is greater than or equal to 4 hours.
5. Client hereby releases and authorizes the Videographer to use images, names, sounds, etc. of the event and any reproductions and/or recordings of them in connection with any contest, exhibition, display, airing, advertising promotion, newsletter, publication, and inclusion in demonstration tape(s) or other purposes. In return, Videographer agrees to use them in good faith and good taste.
6. Client warrants that all participants at the non-public event freely give their consent to being audio recorded and videotaped as part of the production and consent to the same good faith usages of their likeness images and/or voices previously described in paragraph 5.
7. Videographer is hereby granted full editorial and production control by client regarding all aspects of the production and post-production services for the event. In the event a particular segment of the event is either not recorded, partially recorded, or not a part of the edited master tape, it is the sole discretion of the Videographer as the exclusive producer of the event. Raw footage of the event remains the property of the Videographer.
8. Videographer will do its best to complete all projects within the time period quoted from the latter date of either the event date or date client delivers all materials necessary to complete the project (estimated within 3 weeks after these dates). The completion period is only an approximate length of time and any longer periods necessary for completion will not void this contract. Videographer will notify client of such circumstances and try to give client a new approximate completion date.
9. All personal property provided by client to Videographer for utilization in the production of their video is received by the Videographer at the complete and total risk of client. Client warrants that he/she has the legal rights to such materials. Client agrees to indemnify and hold Videographer harmless for the loss, damage or liability for infringement of any rights arising from the use of material in client's video. Videographer will make every effort to insure the safekeeping of client's personal property while in its possession and return same to client upon delivery of the edited program copy.
Photographs are due two weeks before the event date. All material will be mailed back to client via USPS postage which will be billed additionally.
10. Videographer retains all copyrights and reproduction rights for each production. Client may use production or copies for private use, unless other permission is granted in writing by Videographer.
11. Postponement or cancellation policy: In the event of cancellation by client on or before 60 days of event, a 30% booking fee will be retained from all deposits. For cancellations 30 days or less from event, a 50% booking fee will be retained from all deposits received. In the event of cancellation due to weather or other natural events beyond either parties’ control, an alternate day will be scheduled with the wedding party or the deposits, excluding a 50% booking fee, will be refunded. All attempts to reschedule will be made by both parties prior to cancellation due to such events. Examples of weather or natural conditions include, but are not limited to: mandatory evacuation orders, natural disasters, flooding, power outages, etc.
12. Payment terms: 50% of package cost required for deposit to reserve date. Additional 25% of package cost due 60 days before the event. Final payment (remaining 25% of package cost and any additional charges such as postage, add-ons,
etc.) due prior to shipment of program copy DVD(s).
13. When the event activities extend beyond agreed time in coverage, overtime
charges are billed in hourly increments and will be billed at the next
corresponding hourly rate packaging price (e.g. an Eloper’s Special that
runs 3 hours would be billed at the 3 hour Sunset Deluxe Package rate);
thereafter additional hours are billed in one hour increments at the current
rate of $200.00 per hour, until such time as the client informs Videographer to
discontinue or the client has departed or the event has concluded.
14. If Videographer fails to comply with the terms of this agreement due to any event or act beyond the control of Videographer, including but not limited to illness, accidents, labor disputes, acts of God and other catastrophes (except as noted in paragraph 11), or uncontrollable and unforeseeable equipment failure, Videographer’s liability is limited only to refund of all moneys received.
15. If any portion of this agreement should be determined invalid or non-applicable, it is agreed that the invalidity of such portion shall not affect the validity of the remaining portions of this agreement. The remained of this agreement remains effective.
16. This agreement supersedes and replaces any previous documents, correspondence, conversation, or other written and/or oral understanding.
17. This contract is being provided to you at your request and as per the date indicated on the contract, we have reserved time on our production schedule for your event. To confirm your reservation, it is necessary for you to sign and return one copy of this contract with your initial payment of 50% to Videographer within ten days of receipt, or your reservation may be canceled without prior notification. If additional time is needed, please contact Videographer.
